Real estate surveying is a largely two-dimensional world, but Peter Tolensky is working to add a new legal dimension to the field.
A partner at Vancouver-based Clark Wilson LLP, Tolensky has been involved in numerous developments across the province over the past nine years. He’s one of a handful of lawyers with expertise in dealing with the airspace subdivision of real estate, the creation of separate legal parcels of property existing in different areas of airspace above a plot of land.
“It’s a three-dimensional subdivision where you have [separate] legal parcels in one building and it operates to make these owners neighbours rather than owners of the same building.”
With his experience, he now chairs the Air Space Taskforce, a joint effort of the Canadian Bar Association and the Association of BC Land Surveyors who are working with the provincial government to reform and standardize the technical aspects of airspace subdivision.
Known in the industry as a “deal-maker,” the married father of two sons has worked with several players in real estate development, including past BIV Forty Under 40 recipients Robert Fung of the Salient Group, Cameron McNeill of MAC Marketing Solutions, Hani Lammam of Cressey Development Group and Jennifer Podmore of MPC Intelligence.
His reputation has been helped by his experience in dealing with complex business deals and projects, especially for the growing number of mixed-use projects throughout the province, including Cressey’s Duke, Elan and Lotus projects, Salient’s Garage and Varsity projects and Townline’s Hudson project in Victoria to name just a few.
It’s all groundbreaking work, but he still finds the time to be with his family and contribute to the community. In addition to supporting the Building for Kids campaigns for BC Children’s Hospital in the past, he is involved in raising funds for the Jewish Family Services Agency through its annual Innovators Lunch. •
