1.1 The contents of the BIV online (also know as "The Service") are intended for the personal, noncommercial use of its active subscribers. All materials published on the BIV online service (including, but not limited to news articles, photographs, images, illustrations, audio clips and video clips, also known as "The Content") are protected by copyright, and owned or controlled by BIV Publications Ltd., or the party credited as the provider of the content, software, or other materials. Users shall abide by all additional copyright notices, information, or restrictions contained in any content accessed through the service.

1.2 The service is protected by copyright as a collective work and/or compilation, pursuant to Canadian copyright laws, international conventions, and other copyright laws. Subscribers may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, perform, display, or in any way exploit, any of the content, software, materials, or service in whole or in part.

1.3 A user may download or copy the content and other downloadable items displayed on this Service for personal use only, provided that subscriber maintains all copyright and other notices contained in such content. Users shall not store any significant portion of any content owned by, or licensed to BIV, in any form. Copying or storing of any content for other than personal, noncommercial use is expressly prohibited without the prior written permission from BIV, or the copyright holder identified in the individual content's copyright notice. BIV will not be held liable for any delays, inaccuracies, errors or omissions therefrom or in the transmission or delivery of all or any part thereof or for any damages arising from any of the foregoing.

2. WARRANTEE

2.1 BIV Publications Ltd. and its employees, directors and agents (hereinafter "BIV") stipulate as a condition of use and supply of the service and all downloadable software that, in respect of any single transaction or multiple transactions BIV is liable for damages only up to the amount of money or money's worth paid by the claimant in the transaction or transactions, which payment was to BIV, and in no event shall BIV collectively or individually be liable for any greater sum than the total sum received by BIV in respect of transactions causing the loss, whether the loss arises from negligence, breach of contract or breach of statutory duty.

3. SUBSCRIBER SERVICES

3.1 A subscriber may not (i) select or use a subscriber ID of another person with the intent to impersonate that person; (ii) use a name subject to the rights of any person other than subscriber without authorization.

3.2 A subscriber shall notify subscribe@biv.com of any known or suspected unauthorized use(s) of their account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of a subscriber ID or password.

3.3 A subscriber shall be responsible for maintaining the confidentiality of their subscriber ID number.

3.4 A subscriber may share their BIV subscriber ID and password with a maximum of 10 other individuals within a single company or organization. All authorized third party users must work and/or reside at the address specified on the subscriber's BIV mailing label.

3.5 Each subscriber is responsible for all usage or activity on their BIV account, including use of the account by any third party authorized to use a subscriber's BIV ID and password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of Subscriber's account, at BIV's sole discretion.

4 SUBSCRIBER E-MAIL

4.1 BIV reserves the right to send electronic mail to any and all Subscribers, to for the purpose of informing them of changes or additions to the Service, or of any BIV related products and services.

5. SOFTWARE LICENSES

5.1 BIV may, in its sole discretion, terminate or suspend a subscriber's access to all or part of the service for any reason, including, without limitation, breach of these terms.
