Local golf course suing fertilizer company for damage to greens

Marine Drive Golf Club (MDGC) has filed a notice of civil claim in BC Supreme Court against a Quebec-based fertilizer company.

The golf club claims that Ferti Technologies Inc. and its distributors and suppliers provided a fertilizer that burned the course’s greens so badly they became unplayable.

MDGC wants compensation for loss of revenue from greens fees, related goods and services (food and beverages, rental services and retail products) and the cost of investigation, remediation and repair of the damage.

The incident occurred in late 2009 and MDGC claims that, in correspondence with the defendants, it was not informed that the fertilizer contained any inorganic substances, including nitrogen. Had this information been disclosed, the suit claims that different application methods would have been used.

The golf club is looking to be awarded general and special damages, interest and remuneration for the costs of this action.
