City ordered to halt construction on Kits Point bike path

The Supreme Court of British Columbia has ordered that the City of Vancouver and the Board of Parks and Recreation halt any construction of a proposed bike path through Kits Point's Hadden Park until a hearing to determine the path's legality can be held.

The Supreme Court of British Columbia has ordered that the City of Vancouver and the Board of Parks and Recreation halt any construction of a proposed bike path through Kits Point's Hadden Park until a hearing to determine the path's legality can be held.

A lawsuit was filed November 4 by historian Megan Carvell Davis. The suit alleges that construction of the bike path goes against the wishes of Harvey Hadden, who had donated the land to the city in 1928. At the time of the donation, Hadden had stipulated that the land be kept in its "natural state."

"We are encouraged that the City of Vancouver and the Vancouver Park Board obtained legal advice and have consented to having an injunction in place against them," said Robert Kasting, Davis' legal counsel. "The City is court-ordered to halt any construction of the bike lane through Hadden Park until the court addresses Ms. Carvell Davis' petition."

Critics of the path have held rallies to protest the construction, saying they were not consulted and that it will damage the natural greenspace in the park.

The Park Board has declined to speak on the matter. The trial date has not been set.
