Wesgar Inc. is suing the International Association of Bridge, Structural, Ornamental and Reinforcing Ironworkers, Shopmen’s Local 712 and an unknown company employee after the union allegedly began contacting Wesgar employees to persuade them to join the union using a confidential database of emergency contact information.
Wesgar filed a notice of civil claim in BC Supreme Court on June 9. The company claims it began receiving complaints from employees in March about being contacted by the union after their shifts through their emergency contact numbers. Some employees, according to the claim, received a voicemail with a call back number from someone claiming to be Wesgar’s CEO. However, when they called back, it turned out to be someone from the union urging them to join.
Wesgar claims the union acknowledged that a company employee provided the database, but allegedly refused to identify them and return the database.
The company seeks damages for breach of privacy, conversion, and breach of confidence. The allegations have not been proven in court and the defendants had not filed a response by press time.
