Court orders repayment of $6.5 M to investors in vacation scheme

The Federal Court of Canada has ordered a UK immigrant who may be facing deportation to pay back more than $6 million to investors – many of them from B.C. – who invested in a vacation scheme his company ran.

The Federal Court of Canada has ordered a UK immigrant who may be facing deportation to pay back more than $6 million to investors – many of them from B.C. – who invested in a vacation scheme his company ran.

In January, the court issued a summary judgment against Allan Kippax and his Business in Motion International Corp., according to Branch MacMaster LLP, which represented litigants led by B.C. resident Mark Cuzzetto in a class action lawsuit.

On February 5, the court ordered Kippax to repay investors $6.5 million.

Kippax ran a vacation scheme called UltraLife Club, in which investors were told they could invest in vacation packages, which they could then resell at much higher prices.

Branch MacMaster has concerns that Kippax could leave the country before litigants are repaid. According to rhe law firm, Kippax is currently being held in custody at the Central East Correctional Centre in Lindsay, Ontario on immigration detention.

"Mr. Kippax is under imminent risk of deportation," the firm says on its web site. "We would like to find money for distribution to class members before Mr. Kippax is out of the jurisdiction."

The firm asks that anyone knowing where Kippax or Business in Motion may have funds to contact the firm.
