Geological services firm ResourceEye Services Inc. is suing two mining companies for allegedly not paying an invoice for work performed.
ResourceEye alleges in its notice of civil claim, dated April 26, that it signed an agreement in 2008 to work on West Hawk Development Corp.’s Groundhog project in northern B.C.
ResourceEye claims that it was not completely paid for its work and that the agreement that it signed stated that if it were not fully paid, that it would retain ownership of the work performed.
In November 2011, Atrum Coal Groundhog Inc. bought the project and then allegedly started using the data and analysis that ResourceEye claims it produced.
Both West Hawk Development Corp. and Atrum Coal Groundhog Inc. are listed as defendants.
“Atrum Coal has without license, permission, authorization or attribution reproduced ResourceEye’s analysis and data on its website,” ResourceEye alleges in its notice of civil claim.
ResourceEye further claims that Atrum has used its data in promotional materials, disclosure materials and securities filings.
In Atrum’s May 29 response to the notice of civil claim, the company denies that ResourceEye owns the data and analysis. Atrum also denies that it has improperly used the data and analysis in any way.
“The plaintiff has no copyright in the materials allegedly used by the defendant and if the plaintiff’s materials are subject to copyright, the defendant did not breach that copyright,” Atrum notes in its defence.
None of the allegations has been proven in court, and West Hawk had not filed a response to the lawsuit by press time.
