Two Lower Mainland contractors are being sued after a house guest was allegedly injured by a falling light fixture.
Zayran Irani, a retired administrative assistant from Naples, Italy, is suing Delta-based Pinnacle Homes Ltd. and Surrey-based Grimes & White Electric following injuries that she claims she sustained while staying with her brother, Bob Mazdine, and his wife, Franak Mazdine.
The Mazdines are also named as defendants in the suit.
According to a statement of claim filed in BC Supreme Court January 12, Irani arrived at the Mazines' home from Italy on January 20, 2010.
The court document states that she was jetlagged upon arrival at the Mazdines' Delta residence and went to sleep shortly thereafter.
The statement of claim alleges that at or around 12:35 a.m. on January 21, 2010, while Irani was asleep in a guest bedroom, a large light fixture in the centre of the bedroom "came crashing down" on her left calf.
Irani is alleging negligence on the part of Pinnacle and Grimes & White. She is claiming, among other things, that the plaintiffs: "fail[ed] to give the plaintiff warning, or in the alternative, any adequate warning of the negligent installation of the ceiling mounted lighting fixture in the Mazdines' premises."
Irani claims that she has suffered injuries including insomnia, nervousness, depression, fatigue and permanent injury to the left calf.
She is seeking damages.
None of these allegations have been proven in court.
As of press time, no response to the claim had been filed.
