Joey sued for flood damage

A dry cleaner is suing Joey Restaurant Group for failing to prevent sewage and water from seeping from the chain’s Bentall Centre restaurant into the dry cleaner’s premises.

A dry cleaner is suing Joey Restaurant Group for failing to prevent sewage and water from seeping from the chain’s Bentall Centre restaurant into the dry cleaner’s premises.

Woodman’s Cleaners Ltd. suffered damage and then changed its corporate name to 0125662 B.C. Ltd., which is suing Joey Restaurant (Bentall One) Inc.

0125662 B.C. Ltd. claims that on October 10, 2009, raw sewage and water flooded the floor of Woodman’s Cleaners.

“As a result of the flood, Woodman’s suffered damage, loss and expense which were forseeable by Joey,” according to the statement of claim.

0125662 B.C. Ltd. seeks general and special damages in addition to prejudgment interest under the Court Order Interest Act and costs.

The numbered company claims that the restaurant chain is responsible for the negligence of its employees to properly maintain and and use the grease trap. Those employees, according to 0125662 B.C. Ltd., failed to ensure that the grease trap did not exceed appropriate temperatures.

“The activities carried out by Joey’s on its premises were inherently dangerous and Joey’s is responsible and strictly liable for damage caused,” 0125662 B.C. Ltd. notes in its statement of claim.

Joey Restaurant Group had not filed a statement of defence by press time. •
