Lawsuit of the week: Shoddy roofing work to blame for costly repairs to Terminal City Club elevators, strata claims

The strata corporation responsible for the Terminal City Club is suing Macbeth Roofing Corp., claiming shoddy work done to the club’s roof in the summer of 2016 caused water damage that rendered the building’s elevators inoperable.

Strata Plan LMS 3699 filed a notice of civil claim in BC Supreme Court on September 13. According to the claim, the strata hired Macbeth in August 2016 to install a new membrane roofing system, with work beginning in September.

“On or about September 17, 2016, the strata discovered that one or more elevators at the Terminal City Club were malfunctioning and inoperable,” the claim states. 

Repairing the elevators cost $62,246 and roof inspectors “discovered several leaks in the roof of the Terminal City Club,” determining that the membrane installation was defective. Macbeth allegedly failed to “completely adhere the roofing membrane to the concrete substrate” and to “allow the asphalt primer to dry prior to installing the roofing membrane.”

The strata seeks damages for negligence and breach of warranties to cover the costs of the elevator repairs. The allegations have not been tested or proven in court and Macbeth Roofing had not responded to the claim by press time.
