Lawyer sues client over commission for sculpture sale

Cascade Law Corp. is suing its former client Kevin Stone and Metal Animation Studio Inc. for a slice of the $168,000 sale price for a stainless steel eagle sculpture, which has a wingspan of 31 feet.

Stone allegedly signed an agreement with Cascade in June 2006 to provide legal services to help retrieve possession of the eagle sculpture, which Stone contended was in the possession of unlawful owners.

The alleged agreement was for Stone to pay Cascade 20% of the gross settlement plus disbursements up to $600,000 plus 20% on any remaining amount plus disbursements.

Cascade filed a statement of claim against the eagle sculpture’s unlawful possessors in September 2008 and essentially won the case, according to the current statement of claim filed January 14.

Justice Grant Burnyeat allegedly ordered an injunction restraining the eagle sculpture’s alleged unlawful possessors from selling or disposing of it. And Burnyeat ordered that the eagle sculpture’s unlawful possessors deliver the sculpture to Stone.

Stone then allegedly sold the eagle sculpture to Tom Blaney for $168,000 and, according to the alleged agreement that Stone and Cascade signed in June 2006, would have owed Cascade $39,004.

Cascade allegedly sent a letter demanding payment. Stone allegedly agreed to pay and then issued a cheque. Stone then allegedly had a stop payment order placed on the cheque.

Cascade is seeking $39,004 plus damages including punitive damages.

No statement of defence had been filed by press time.

None of the allegations has been proven in court.
