A Vancouver architecture firm is suing a group of companies over unpaid design bills for a vineyard and marina project in the Okanagan.
In its March 22 claim, Perkins & Will Canada Architects alleges that it was hired in 2009 by a group of companies and people, comprised of:
- KAK Enterprises;
- Kenneth Enders;
- 0843710 B.C. Ltd.;
- Bender Holdings Ltd.;
- Voyage Ventures Ltd.;
- 0857544 B.C. Ltd.;
- 0864901 B.C. Ltd.;
- R. Hennessy Lumber Ltd.;
- Rock House Ventures Ltd.;
- 0891359 B.C. Ltd.;
- ABC Company 1; and
- ABC Company 2
The suit alleges that the group was formed in 2008 and operated under the name Okanagan Waterfront Development Group. The entity planned to develop a vineyard and marina near Kelowna.
Perkins & Will claims that it provided $217,982 worth of architectural planning and design services for the project, but that its invoices were never paid.
A response filed on April 30 states that the defendants did not agree to the proposals the plaintiff submitted, with the exception of one proposal dated February 9, 2011. They claim there was an agreement between the parties that the fees would be payable in phases. The defendants allege that fees payable at the end of the concept phase were to be $117,477, and that the project is still in the concept phase.
None of the allegations has been proven in court.
