A trucking business is suing Encana and Spectra Energy Transmission after a semi tractor-trailer accident on a road near Fort Nelson.

In its suit, filed April 13 and re-filed with some changes May 29, Jones Transportation Inc. claims that on May 11, 2011, a semi trailer it owned rolled over on Komie Road.

Jones Transporation claims that as the owner of Komie Road, Encana was responsible for maintaining the roadway and making sure it was safe to travel on. The transport company claims that Encana “represented” that Komie Road was safe to travel on.

Jones Transportation is claiming damages from:

  • the cost of investigating the accident;
  • the cost of repair to the semi trailer;
  • business interruption;
  • cost of alternate accommodations while repairs were being made;
  • diminished value of the semi; and
  • stress, inconvenience and hardship.

None of the allegations has been proven in court.

No statement of defence had been filed by press time.
