The owner of a swing-span bridge that traverses the Fraser River between Marpole and Lulu Island is suing the owners of a tugboat after it allegedly collided into and damaged the bridge.
Bridge owner Canadian Pacific Railway Co. (CPR) filed suit February 23 in BC Supreme Court, contending that CPR has suffered losses after a tugboat and/or barge struck and damaged the bridge's protection pier.
The court document claims that the collision occurred on or about March 1, 2010.
Named as defendants are: the owners and all others interested in the ship North Arm Prowler, tugboat owner and operator North Arm Transportation Ltd., tugboat master John Doe and barge owner John Doe Ltd.
"The collision," the statement of claim alleges, "was caused by the fault and negligent navigation, management or operation of the tugboat by North Arm and its servants or agents, and by the operators, Master, officers or crew of the tugboat, and/or of the barge, individually, or jointly, or by some combination thereof."
CPR is seeking damages and special damages, including the cost of repairing the bridge.
None of these allegations has been proven in court.
