U.S. sign company ES&A Sign Corp. is suing BC Pavilion Corp. (PavCo) as well as another U.S. company for $737,000 related to work on the BC Place renovation.
The legal action, dated December 14, follows other lawsuits filed by other subcontractors, such as the Jim Pattison Group, related to work on the stadium.
ES&A, which does business as ES&A Sign and Awning Co., claims that Murdlaw Inc., which did business as TS Sports, failed to pay invoiced amounts.
PavCo was named as a defendant in the suit because PavCo is the registered owner of both the stadium and its lands and PavCo oversaw the entire project.
PavCo contracted PCL Constructors Westcoast Inc. as the head contractor. PCL then subcontracted some work to TS Sports, which in turn subcontracted work to ES&A.
The disputed invoices related to work that ES&A authorized on the understanding that it would be reimbursed by TS Sports.
"[ES&A] was directed by TS Sports to add bracing for the two small underbelly signs [on the stadium's centre-hung video board]," ES&A alleges in its note of civil claim.
"TS Sports did not have an account established with the local steel supplier so it was agreed that one of the plaintiff's subcontractors would accept this charge on its account and pass it along to the plaintiff, and that TS Sports would then reimburse the plaintiff. The amount claimed is the amount invoiced by the subcontractor as agreed."
