Westin Bayshore sues for flooding damages

Owners and operators of Vancouver's Westin Bayshore Resort & Marina are suing for damages after a fire suppression system allegedly failed and caused water damage to the property.

Plaintiffs Starwood Capital Group Global, the Westin Bayshore Vancouver, Blue Tree Hotels GP ULC and Blue Tree Hotels LP filed suit in BC Supreme Court June 1, seeking $200,000 in damages for alleged failures of the fire suppression system on June 14, 2010, and October 31, 2010.

The suit names as defendants:

  • Gage-Babcock and Associates Ltd., the fire protection design consultant and engineer of record for the initial design, consultation and installation of the system;
  • Rich-Teck Industries Ltd. and Lake Mechanical Ltd., which installed system components and performed periodic maintenance and testing of the system; and
  • 0777792 B.C. Ltd. operating as Vancouver Fire & Security, which performed inspections of the system.

The suit alleges that a pipe cracked in the fire suppression system, causing water to be discharged into the property.

"As a result of the discharge of the water, the Westin Bayshore suffered damages relating to the emergency clean-up costs, remediation, and repair of the building," the suit alleges.

"The Westin Bayshore also suffered damages relating to expenses incurred in the adjusting and investigation of the property damage."

The suit contends that the defendants are liable for breaching express or implied contracts by "fail[ing] to recognize the over-pressurized state of the fire suppression system and fail[ing] to adequately perform their duties under their contracts with the plaintiff and remedy the condition."

None of these allegations has been proven in court.
