Three doctors and their medical company are suing Vancouver-based QHR Software Inc. for losses they allege they sustained after using the QHR’s medical records and billing software.
Plaintiffs and physicians Lica Chui, Justin French and Farzin Forooghian, as well as company Lica Chui M.D., Inc., filed suit against QHR in the BC Supreme Court March 12.
According to the suit, Chui, on behalf of Lica Chui M.D., Inc., entered into an agreement in January 2010 to use what was then Optimed Software Corp.’s software for electronic medical records and billing. The suit states that the other plaintiffs also worked for Lica Chui M.D., Inc.
The court document describes errors that the plaintiff company made in entering its claims submissions to the B.C. Medical Services Plan (MSP). It alleges that, upon discovering the errors, the company asked Optimed for assistance and Optimed offered to perform a mass debit and resubmission of the claims.
As part of that process, the plaintiff company allegedly repaid $69,969 to MSP.
The claim also states that Optimed advised the plaintiff company that an explanatory note needed to be included in each submission and that the plaintiff company complied with this request.
It contends that on October 14, 2010, Optimed advised the plaintiff company that it had successfully resubmitted the claims with the explanatory note.
The court document states that on January 1, 2012, Optimed, QHR and two other companies were amalgamated into the defendant, QHR.
The suit alleges that on or about February 20, 2012, MSP advised the plaintiff company that it had never received the resubmitted claims. It further contends that on March 8, 2012, MSP advised the plaintiff company that it would not accept resubmitted claims because the services rendered in the claims were more than 18 months old.
The plaintiffs are alleging breach of contract and negligence on the part of QHR and suing for damages.
None of these allegations has been proven in court.
